מה שאסרת התרתי ומה שהתרת אסרתי


 The Star-K last week distributed the spring edition of their magazine. There was an article on the Halachic issues of drinking Starbucks coffee. Unfortunately their Halachic decisions are all wrong as I will explain. The following is based on the assumption that there is no issue with the ingredients of the coffee and the utensil used to drink the coffee is from paper. The only issue is with the urn used to cook the coffee. It appears there is a ספקif the brew basket is  בולע איסור at the time of washing with other utensils. 

The brew basket can fall into 1 of 3 categories. 1> וודאי אינו בן יומו– we know for sure  that 24 hours have passed since the utensil has absorbed the איסור2>  סתם כלים אינם בני יומן– we have a ספק ספיקהthis means there are 2 ספיקותone if the 24 hours have passed the second if the בליעהwas אסורthis category is treated the same way as category 1             3> when we have only one ספק– the בליעהwas וודאי אסורbut we are not sure if 24 hours passed or else we know for sure that the utensil is a בן יומו (24 hours have not passed) but we have a ספקif the בליעהis prohibited. This category is always prohibited. The first 2 are permitted under certain conditions.

I have never inspected a Starbucks shop so I am basing everything on the contents of the article. Since there is no mention otherwise we can assume the position determined by conventional wisdom, that the brew basket is washed at least once daily to maintain the cleanliness and freshness of the coffee. This then is the classic case of וודאי בן יומו וספק בליעה category 3 which is 100% prohibited. The Psak for category 3 is brought by the Bais Yosef in Siman 122. It is also brought by the Ramoh in 122.9.  Therefore  if one is on the road or off the road or anywhere in between he is not allowed to use Starbucks coffee.                                                   

We must now clarify the issues of  אב''יin category 1& 2.We will use a hypothetical scenario where a Starbucks was closed for a Sunday , and we know the dishes were washed Saturday night (this is category 1) or else we have a  ספקif the store was closed on Sunday (this is category 2). We come on Monday morning what is permitted and what is prohibited. This is discussed by the  Shulcah Aruch and Ramoh 122.6 and Shach 122.5.  the Shach states that if The Non-Jew boiled water for the Jew to drink this is called a בדיעבדsince a complete product was produced and it is permitted to drink the boiled water. 

If the water was boiled for the purpose of kneading flour then this is not a בדיעבדand it is not permitted to purchase the water from the Non-Jew. So if the water was boiled to be used with pre cooked oatmeal etc. One would not be allowed to purchase it, but if it is boiled  for drinking purposes one is allowed to purchase it. Therefore the coffee which is boiled for drinking is 100% permitted and there is no need for any other Heter from the Nodah Beyuda in category 1 & 2. So if the utensil falls into category 1&2 if you are on the road or off the road or anywhere in between it is permitted to drink.

I would urge everyone to look up these Halachos and see if it possible to justify this article. You will probably come to the same conclusion that I have, there is no way to justify the complete misunderstanding of the Halacha and therefore any Hechsher from this organization is suspect and cannot be relied on.

         Re: Pesach Hotels- For the educated kosher consumer that is concerned about kashrus standards and hotel atmosphere- we cannot recommend any of the current Pesach hotels.   

Rockland county measles outbreak may affect their matzas. 

*Sephardim- Alert: Gluten free cakes must be Bishul Yisroel BY-check with bakery if it is. Most all are not BY.

Shabbos Friendly appliances certified by Star-K  are not recommended.

GE Refrigerator with OU Shabbos keeper is recommended for Shabbos.

UGG products must be checked for Shatnez by a Shatnez expert tester.

Alert: Monsey/Lakewood Kreitman labs-aren’t reliable for Shatnez.

Alert: fruits and vegetables from Israel, Tithes must be taken.

Garlic- fresh infested w/ mites- pre-peeled use only China not USA

Kosher Water meters in Lakewood & Monsey are not mechanical, but electric and are a serious Shabbos issue. Eretz Yisroel developed real kosher meters.

Dear Friend,
 I have become aware that there are those who are wearing hemp ציציתon cotton and linen garments.
 One doing so, has not fulfilled his obligation of ציצית. He is actually transgressing the mitzvah of ציצית, by wearing a four cornered garment that requires ציצית, without wearing ציציתthat fulfills his obligation. In addition, if he makes a ברכה on the ציצית, he is making a ברכה לבטלה!

The halacha is that only linen and woolen ציצית may be put on any type of garment to fulfill his obligation (excluding of course, woolen ציציתon a linen garment and vice versa which would be shatnez). In regard to other types of ציצית (which is called שאר מינים), they can only be used for the same type of garment, as cotton ציצית for a cotton garment, as stated in Shulchan Orach 9:2-3.

Although, hemp which is called קנבוס by Chazal, is closely related to linen, it is not linen and does not make shatnez with wool. Likewise, it is considered שאר מינים in regard to ציצית.

Therefore, hemp ציצית can only be used for a hemp garment; you can see this brought down in Mishna Berura 9:2.

If someone would want to use hemp ציצית for a hemp garment, he would have to first verify that the garment is actually of hemp, as stated in Hilchos shatnez. This may be very difficult to verify as it looks very very similar to linen.
